1. CONDITIONS AND GENERAL CLAUSES:
- Owner's Obligations: the Owner agrees to make the vessel available at the port of embarkation on the agreed date and time, fully functional, clean and tidy, and sanitized.
- Manner of conducting the CRUISE: The Owner makes no warranty as to the use and comfort qualities of the boat in bad weather conditions for sailing the routes within the chosen sailing area. However, the captain will undertake to conduct the vessel by sailing between safe ports and anchorages within the limits of the agreed itinerary. The cruise schedule may vary at the captain's sole discretion according to weather conditions, or other technical necessities of navigation and mooring. The captain may make any decision he or she deems appropriate to protect the safety of navigation by availing himself or herself of the authority to make variations in the time and manner of reaching planned destinations that are difficult to reach, impractical or unavailable. By virtue of climate change and the unpredictability of weather and sea conditions, in order to optimize the vacation, it is advisable and in some cases mandatory to book berths in the ports of the destinations to be reached.
- Obligations of participants: they are required to inform the skipper prior to boarding, on a strictly personal basis, of any health problems, drug or food allergies, motor difficulties, other specific needs, and if they were unable to swim. Participants are expected to accept any decision the skipper deems appropriate to protect their safety and security by adhering to any assigned positions on board and in wearing life jackets. Participants are required to embark by bringing on board luggage consisting of bags that are unobtrusive, soft and fully collapsible so that they can be easily stowed. Luggage should be limited and essential. Each participant is the sole custodian of his or her belongings and is personally liable for theft, loss or damage. He/she is also responsible for damage caused to the boat by wilful, negligent behavior or behavior contrary to the instructions given by the skipper. Please note that smoking is not allowed below deck while you may smoke exclusively in the cockpit only when you are not sailing and taking the necessary precautions not to cause damage to the boat and annoyance to other participants.
- Breakdowns and breakdowns. In the event of unforeseen breakdowns or failures requiring a stop for repair, The Owner agrees to make this period as short as possible. If the period does not exceed 48 continuous hours, the User will not be able to claim any refund. Otherwise, the Owner will refund each day not enjoyed beyond the said 48 continuous hours.
