Conditions and Clauses

  1. CONDITIONS AND GENERAL CLAUSES: 
  1. Owner's Obligations: the Owner agrees to make the vessel available at the port of embarkation on the agreed date and time, fully functional, clean and tidy, and sanitized. 
  2. Manner of conducting the CRUISE: The Owner makes no warranty as to the use and comfort qualities of the boat in bad weather conditions for sailing the routes within the chosen sailing area. However, the captain will undertake to conduct the vessel by sailing between safe ports and anchorages within the limits of the agreed itinerary. The cruise schedule may vary at the captain's sole discretion according to weather conditions, or other technical necessities of navigation and mooring. The captain may make any decision he or she deems appropriate to protect the safety of navigation by availing himself or herself of the authority to make variations in the time and manner of reaching planned destinations that are difficult to reach, impractical or unavailable. By virtue of climate change and the unpredictability of weather and sea conditions, in order to optimize the vacation, it is advisable and in some cases mandatory to book berths in the ports of the destinations to be reached.
  3. Obligations of participants: they are required to inform the skipper prior to boarding, on a strictly personal basis, of any health problems, drug or food allergies, motor difficulties, other specific needs, and if they were unable to swim. Participants are expected to accept any decision the skipper deems appropriate to protect their safety and security by adhering to any assigned positions on board and in wearing life jackets. Participants are required to embark by bringing on board luggage consisting of bags that are unobtrusive, soft and fully collapsible so that they can be easily stowed. Luggage should be limited and essential. Each participant is the sole custodian of his or her belongings and is personally liable for theft, loss or damage. He/she is also responsible for damage caused to the boat by wilful, negligent behavior or behavior contrary to the instructions given by the skipper. Please note that smoking is not allowed below deck while you may smoke exclusively in the cockpit only when you are not sailing and taking the necessary precautions not to cause damage to the boat and annoyance to other participants.
  4. Breakdowns and breakdowns. In the event of unforeseen breakdowns or failures requiring a stop for repair, The Owner agrees to make this period as short as possible. If the period does not exceed 48 continuous hours, the User will not be able to claim any refund. Otherwise, the Owner will refund each day not enjoyed beyond the said 48 continuous hours. 
2. PAPERED COST. 50% down payment at booking and balance 30 days before embarkation.  Included in the agreed cost is the rental of the boat with Skipper performing the function of conducting and commanding, the use of the boat with its auxiliary engine, the use of the Sup, the use of sails, the use of electricity, inverter, on-board appliances of wi-fi, on-board linens (sheets, towels and beach towel), fresh water, awning, mooring and services in the port of Marina d'Arechi in Salerno, docking, boarding and disembarking in the port of Amalfi, insurance against third parties carried, and the cost of final cleaning.  Not included in the fee are boat fuel costs, mooring and port charges, galley. 3. WAIVER OR DISCONTINUATION Should the User be unable to make the departure, he/she shall give timely notice to the Owner who shall retain: the deposit, if the notice is made before the balance; the deposit and balance, if the notice is made more than one month before the departure. If the cruise is interrupted at the request of the User, the User shall not be entitled to any refund.  Exceptionally, if agreed in advance and stated in the rental agreement, in case of cancellation of the rental more than one day, a refund of 70% of the amount is possible up to 10 days before departure excluding handling costs and fees. Exceptionally, if agreed in advance and indicated in the charter contract, in case of daily charter there is no refund but will be guaranteed charter on another date to be determined according to availability of the Owner. 4. FAILURE TO USE. The Owner assumes no responsibility for delays in departure or interruptions of the cruise due to adverse weather conditions, contrary provisions of maritime authorities, or impediments of a personal nature of the user or his guests. In such cases the charter contract will commence equally and the total charter amount will remain vested in the Owner. 5. REFERENCE TO LEGAL REGULATIONS For all matters not expressly stipulated in this contract, reference is made to current legislation. 6. CONTROVERSIES For any dispute that may arise in dependence of this contract, competent and exclusive jurisdiction will be that of Naples, any other possibly competing forum excluded.
